      “Mary’s story”

      Declaration of Mary Scott/MacPhilimy 1816

The following is a transcription of the original 3 page document and contains spelling and capital letters as recorded in the document. Most of it is legible but words in italics are a guess at what is recorded.

At Ayr the nineteen day of March eighteen hundred and sixteen years in presence of William Eaton Esq Sheriff Substitute of Ayrshire and in consequence of a warrant granted by him on a petition at the instance of Alex Murdoch Master ??? procurator fiscal of court dated the month current Appeared Mary Scott wife of William McPhilimy labourer at Glenbuck Parish of Muirkirk and County of Ayr who being examined declares that her husband and her live in part of the farm houses of lower Glenbuck taken from John Somerville the tenant. That about two months ago she remembers Walter Graham Supervisor of Excise in Ayr, William Duncan Excise officer in Mauchine and another two Excisemen came to Glenbuck, and seized a still in the flat below where the declarant and her husband live, but the declarant does not know to whom the still belongs or whom possisses the apartment where it was. That they also seized another still in a house adjoining and they took under their charge these Balls of Bear which was at a neighbouring door belonging to the declarant’s husband. That they also took possession of some casks in which mash had been, but to whom they belonged she cannot say. That they put the Bear, the worms and the casks upon a cart which they got from John Somerville and they were proceeding on the road to Muirkirk. That the declarant, her husband and several others followed them and that the declarant had a pocher in her hand. That the declarant her husband asked the Bear back. That Mr Graham told them the law was open to them as well as to the excise. That they insisted upon the cart turning and that Mr Graham mentioned that they might take it if they insisted upon it. That William Duncan refused to allow it, upon which the declarant gave him a stroke with the pocher which brought him to the ground and she thinks she gave Mr Graham a little touch with the pocher in going by. That there were a great numbering of persons present and they succeeded in turning the horse and cart and took them to Glenbuck, and the man from whom her husband got the Bear got it back and she does not know what became of the worms or Barrels and the foregoing declaration being read over she declares the same contains the truth and she declares she cannot write. In ??? witness the said William Eaton has subscribed each page of this declaration consisting of this and the two preceding pages in her presence and at her desire, place and date aforesaid. Written by Thomas Weir Sheriff Clerk Depute of Ayrshire, before these witnesses Angus Gunn Chief Constable for Ayrshire and the said Thomas Weir.

Signed by William Eaton, Thomas Weir and A Gunn
